MINUTES-REGULAR MEETING-NEW DOSEY TOWN BOARD- SEPTEMBER 11, 2013

Meeting called to order by Chair Dave Fornengo at 7:30pm.  Also present were Supervisors Ken Coveau and Dave Baker, Treasurer Margaret Coveau and Clerk Fran Levings.

Motion by Ken Coveau, second by Dave Baker, to approve the agenda.  Carried.

Motion by Dave Baker, second by Ken Coveau, to approve the minutes of the August 14, 2013, minutes.  Carried.

Treasurer Margaret Coveau presented the Treasurer’s Report.  (Attached to file copy of these minutes).  Fund Balances are:  General Fund-$12,884.82, Road & Bridge Fund- $22,349.96, Cemetery/Landscaping Fund- ($89.06), Fire Protection Fund- $6178.78, Fire Hall Fund- $125.45, Cartway Fund- $89.15, Savings Account- $1155.92, Driveway Fund- $1767.32 and CDs- $44,010.54.  Motion by Dave Fornengo, second by Ken Coveau, to approve the Treasurer’s Report.  Carried.

Clerk Fran Levings presented the Claims List and the Net Payroll List for approval.  (Attached to file copy of these minutes).  Motion by Dave Fornengo, second by Dave Baker, to pay these bills. Carried.

CLERK’S REPORT:

  1. A legal seminar will be held in Cotton, MN, on Oct. 5.  Clerk is considering attending.
  2. The Clerk and election judge Dave Baker will go to the Pine County Courthouse on Sept. 17 to count ballots for the Special Election held in District 5 for the CountyBoard.

NO ZONING REPORT

OLD BUSINESS:

  1. Chair Fornengo will take care of getting the Internet installed at the town hall.
  2. Supervisor Coveau will take care of repairing the bridge on McDermott Creek Rd.
  3. Consensus was the leave the unwritten culvert policy as it is-  Landowners  will receive one culvert and installation from the township and any further culverts must be purchased by the landowner.

NEW BUSINESS:

  1. The DVD created by Al Holter on Beaver Control will be shown next month.
  2. The Board advised the Clerk to send a letter to the cartway petitioners notifying them that wetland credits must be purchased by July, 2014.

MINUTES-SPECIAL TOWN MEETING- SEPTEMBER 10,2013

MINUTES-SPECIAL TOWN MEETING- SEPTEMBER 10,2013

Clerk Fran Levings called the meeting to order at 7pm.  Also present were Tim Caulfield, Beverly Carlin, Ed Carlin, Don Mishler, Dave Baker, Ken Coveau, Marlene Mishler, Carol Erickson, Joe McCarthy, Jim McCarthy, John Fornengo, Robin Fornengo, and Becky McCarthy.

The Clerk made the following announcements:

  1. The township now has a website-  www.newdoseytownship.com
  2. The public was notified of this meeting via the Pine County Courier, township website, notices on both the bulletin and notice boards, letters sent to all affected landowners, and phone calls made to voters.
  3. The only topic that can be discussed at this meeting is the purpose for the meetings as stated- “to authorize the town board to re-assert authority over the road running for ¼ miles N. of Rutabaga Road near the Wisconsin border.”
  4. Coffee and treats are available.

Dave Baker nominated Ed Carlin to be the moderator.  Ken Coveau seconded.  In lieu of any other nominations, Mr. Carlin was elected moderator.

Motion by Dave Baker, second by Ken Coveau, to approve the agenda. Carried.

Dave Baker gave the background of the town board request to re-assert authority over this road.  He explained that property owner Joe McCarthy is landlocked and the township is responsible for providing access for him.  The town has not worked on this road and via his conversation with an attorney for the Minnesota Township Association, the board must be authorized to spend money on the road.  A “preponderance of evidence now states that this is indeed a road- it has a road order and it looks like a road. He further stated that taxes will not be raised if it is taken over by the township.  He also stated that the DNR will enforce trespassing laws when reported.  The road itself cannot be gated, but the driveway to Mr. McCarthy’s property could be gated.

The floor was then open to comments and questions.

Jim McCarthy stated his concern about passing his property on to his children and would want a road in that case.

Dave Baker cited possible solutions as- (1) the township being authorized to take over the road (2) the property owners could have an easement agreement written up and signed, then at another SpecialTown meeting, the voters could vote to abandon the road.

Joe McCarthy expressed concern about too much 4-wheeler activity on the road.

Beverly Carlin suggested putting up a sign “Private Property”.

Jim McCarthy has concerns about getting stuck on the road.  He & his family would do any necessary repairs.  They do not want to cause problems with their neighbors, but they do want free access.  They would like to see the matter settled.

Dave Baker said the township could recess this meeting and the landowners could in the future work out a private easement.

Becky McCarthy complained about no cell phone reception out there.

Tim Caulfield commented that trespassers will do what they want whether he reports them or not.

Becky McCarthy inquired as to whether or not the easement would stay in place if they sold the property.

Ken Coveau suggested hiring an attorney to help with an easement agreement.

Dave Baker said an easement agreement would be legal forever.

Clerk Levings suggested the following steps for tonight’s meeting at this point- (1) The voters would pass a motion to take no action tonight.  (2) The property owners would work out an easement agreement.  (3)  The township would take steps to vacate the road.

Motion by John Fornengo, second by Beverly Carlin, to take no action at this meeting.  Carried.

Consensus is that the property owners will work out an easement agreement, then notify the township when they have done so.

In response to Becky McCarthy’s inquiry about the width of an easement, Dave Baker replied they are usually 2 rods wide.

MINUTES-NEW DOSEY TOWN BOARD REGULAR MEETING- AUGUST 14, 2013

Meeting called to order by Vice-chair Dave Baker. Also present were Supervisor Ken Coveau and Clerk Fran Levings. Absent were Chair Dave Fornengo and Treasurer Margaret Coveau.

Motion by Ken Coveau, second by Dave Baker, to approve the minutes of the regular July, 2013, meeting. Carried.

Clerk Fran Levings presented the Treasurer’s Report as prepared by Treasurer Margaret Coveau. (Attached to file copy of these minutes). Fund balances are General Fund-$11,390.32, Road & Bridge Fund- $25,464.54, Cemetery/Landscaping Fund- $117.11, Fire Protection Fund- $5316.08, Fire Hall Fund-$125.45, Cartway Fund- $89.15, Savings Account- $1155.92, Driveways Fund- $1647.32 and CDs- $44,010.54. Motion by Dave Baker, second by Ken Coveau, to approve the Treasurer’s Report. Carried.

CLERK’S REPORT:

1. The 2013 Demographics report put the New Dosey population estimate at 72 and the household estimate at 36.
2. Letter sent to Vern Drake, Chair of Town of Blaine in Wisconsin, requiring about roadside brushing.
3. Reminder- Board of Review Training- Rutledge Community Center- Aug. 22 – 6pm.
4. District 7- MAT meeting- Sept. 4- Anoka/Ramsey Community College- Clerk is considering attending.
5. Township will be reimbursed for the expenses of the Special Election for County Board Commissioner- District 5
ZONING REPORT:

1. Land Use Permit # 100- Joni & Norman Dustin- Cabin
2. Land Use Permit # 101- Cevin Chapman- Storage Building

OLD BUSINESS:

1. Ken Coveau will check out the bridge that needs to be repaired.
2. Motion by Ken Coveau, second by Dave Baker, to have the Internet installed in the town hall.
3. Road & Culvert Issues- Bid from Roberts Excavating to haul & spread gravel for $8/yd. and $30/hr. for use of the loader. Dave Baker will talk to Doug Wiita for a status report on remaining road work for 2013. Questions raised about the township culvert policy- Do we install the first one requested and after that, the property owner takes care of it?

NEW BUSINESS:

1. Dave Baker reported that the Duxbury Volunteer Fire Department purchased huge portable pumper truck.
