AN ORDINANCE ADOPTING SUBDIVISION REGULATIONS
IN THE TOWNSHIP OF NEW DOSEY, PINE COUNTY, MINNESOTA

THE TOWN BOARD OF THE TOWN OF NEW DOSEY ORDAINS: AN ORDINANCE REGULATING THE SUBDIVISION OF LAND, IN THE TOWN OF NEW DOSEY, PURSUANT TO THE AUTHORITY GRANTED BY MINNESOTA STATUTES CHAPTER 462.

SECTION I

TITLE AND APPLICATION

Subd. 1 Title. This ordinance shall be known as the “Subdivision Ordinance of the Town of New Dosey.

Subd. 2. Intent and Purpose. The intent of the Ordinance is to protect the public health, safety and general welfare of the Town and its people and to provide for the orderly, economic and safe development of land through the establishment of minimum regulations governing subdivision of land; to provide for administration of this Ordinance; and to provide for amendments to this Ordinance.

Subd. 3 Standard Requirement. Where the conditions imposed by any provisions of this Ordinance are either more or less restrictive than comparable conditions imposed by other Ordinance, rule or regulation of the Town, County, State, or Federal government, the Ordinance, rule, or Regulation which imposes the more restrictive condition standard or requirements shall prevail. In the event of any conflict between this Ordinance and any private restrictions, protections, and covenants, the provisions of this Ordinance shall apply.

SECTION II

SUBDIVISIONS

Policy: Each new subdivision becomes a permanent unit in the basic physical structure of the Township to which, in the future, citizens of the Township will be forced to adhere. Therefore, it is in the best interests of the public health, safety and welfare to provide for the wise subdivision of land when that becomes necessary.

Method: To achieve this policy, the New Dosey Town Board shall follow the procedures in the Pine County Subdivision Ordinance except as provided for in this Ordinance.

Subdivision 1. Minor Subdivsions.

The New Dosey Planning Commission may grant a Certificate of Minor Subdivision as follows:

A. A parcel of record of the effective date of this Ordinance equal to or less than forty (40) acres may be divided into a maximum of two (2) separate parcels. A parcel of record on the effective date of this Ordinance exceeding forty (40) acres may be divided into a maximum of two (2) separate parcels on each quarter-quarter section. Any excess above the quarter-quarter section will be considered a separate parcel and may be divided into a maximum of two (2) separate parcels. Each new parcel shall have a minimum of eighteen (18) acres. Each new parcel shall have a minimum lot frontage of two-hundred yards and a minimum depth of two-hundred yards.

B. A subdivision of land resulting in a parcel with sixty-six feet (66) of frontage on a public road, created to provide access to an isolated parcel of land.

SECTION III

AMENDMENTS

Amendments to this Ordinance shall be allowed pursuant to Minnesota Statutes Chapter 462. Amendments must be requested through the Planning Commission and accompanied by a fee to cover the costs of hearings and other administrative costs The Planning Commission shall set the date of the hearing within 60 days of the day of receipt of the request for an amendment to this Ordinance. The Town Board shall, within 60 days after the date of the hearing held by the Planning Commission, either adopt or refuse to adopt the proposed amendment.

SECTION IV

ENFORCEMENT AND ADMINISTRATION

Subd. 1. This Ordinance shall be enforced and administered by the Planning Commission.

Subd. 2. Applications shall be processed by the Planning Commission.

Subd. 3. Fees shall be set by the Town Board, but shall be no higher than what may reasonably determined to cover hearings and administrative costs.

Subd. 4. Violation of this Ordinance is a misdemeanor.
